Pulteney Town Board Minutes

The regular meeting of the Pulteney Town Board was called to order by Supervisor Weber at 7:00 PM on Wednesday, September 9, 2009, at the Pulteney Town Hall with roll call followed by Pledge of Allegiance. 

            Present were: Supervisor William Weber, Councilman Janet Stone, Councilmen Richard French, Councilman Robert Kemp, Highway Supt. George McIntyre, Town Attorney John F. Leyden and Town Clerk Donna Conley.   Also present was Bookkeeper Helen Coombs, Historian Sharon Daggett, Water Plant Operator Ken Forenz and CEO/Watershed/Zoning Officer Lauren Welch. 
Councilman Stone made motion seconded by Councilman Kemp to accept the minutes of the August 12, 2009 regular meeting.   All in favor.  Carried.

Supervisor Weber gave financial reports.
Councilman French made motion seconded by Councilman Stone to make the transfer in the General Account from A1990.4 the amount of $762.00 to A1620.4 the amount of $500.50 and A1670.44 the amount of $261.50.  Roll call vote:  Councilman Stone, yes; Councilman French, yes; Councilman Kemp, yes; Supervisor Weber, yes.  Carried.

Councilman Stone made motion seconded by Councilman Kemp to pay General Bills in the amount of $10,594.91 being vouchers No. 180 to No. 201on Abstract No. 9.  Roll call vote:  Councilman Stone, yes; Councilman French, yes; Councilman Kemp, yes; Supervisor Weber, yes.  Carried.

Councilman Stone made motion seconded by Councilman French to make the transfer in the Highway Account from D5130.41 the amount of $1,567.94 to D5120.4 the amount of $1,567.94.   Roll call vote:  Councilman Stone, yes; Councilman French, yes; Councilman Kemp, yes; Supervisor Weber, yes.  Carried.

Councilman Stone made motion seconded by Councilman Kemp to pay Highway Bills in the amount of $12,125.78 being vouchers No. 153 to No. 165 on Abstract No. 9.  Roll call vote:  Councilman Stone, yes; Councilman French, yes; Councilman Kemp, yes; Supervisor Weber, yes.  Carried.

Councilman Stone made motion seconded by Councilman Kemp to pay Water District No. 1 Operating Bills in the amount of $601.16 being voucher No. 79 on Abstract No. 9A, the amount of $4.60 being voucher No. 80 on Abstract No. 9B and the amount of $1,886.56 being vouchers No. 81 to No. 89 on Abstract No. 9.  Roll call vote: Councilman Stone, yes; Councilman French, yes; Councilman Kemp, yes; Supervisor Weber, yes.  Carried.

Councilman Stone made motion seconded by Councilman Kemp to pay Water District No. 1 Capital Project bill in the amount of $8,592.99 being voucher No. 7 on Abstract No. 7.  Roll call vote: Councilman Stone, yes; Councilman French, yes; Councilman Kemp, yes; Supervisor Weber, yes.  Carried.

Attorney Leyden explained the process for creating Ambulance District No. 1.  There are 144 parcels in the proposed district.  He explained the order in which things need to be done - (1) SEQR determination of any significant effect on the environment, (2) acceptance of the Map, Plan and Report and (3) the Order to Establish the District. 

(1) Upon motion made by Supervisor Weber and seconded by Councilman Stone, the following resolution was made: 
WITH REFERENCE TO THE TOWN OF PULTENEY ESTABLISHMENT OF AMBULANCE DISTRICT NO. 1 STATE ENVIRONMENTAL QUALITY REVIEW ACT (SEQR) NEGATIVE DECLARATION
WHEREAS, the Town Board of the Town of Pulteney is investigating the feasibility of establishing an ambulance district within the Town; and
WHEREAS, pursuant to Article 8 of the Environmental Conservation Law and the regulations contained in 6 NYCRR Part 617, hereafter SEQR, the Town Board has determined this action to be an unlisted action; and
 WHEREAS, this action is taken by the Town Board after careful consideration of all possible impacts that this action might have on air, water and natural resources, and all other natural and manmade environments in or around the Town of Pulteney and the Town Board has set forth such consideration on forms on file in the office of the Town Clerk.
Upon motion made and seconded, it was
RESOLVED, that the Town Board of the Town of Pulteney hereby designates itself lead agency.
RESOLVED, that the Town Board of the Town of Pulteney hereby determines that the proposed ambulance district will have no significant effect on the environment and hereby issues a Negative Declaration.
RESOLVED, that the Town Clerk shall maintain a file of this determination in the permanent records of the Town of Pulteney, make the same available for public inspection, and notify all involved agencies as required by law.
This resolution shall take effect immediately.
This Resolution was duly adopted by majority vote of the Town Board as follows: Supervisor Weber, yes; Councilman Stone, yes; Councilman French, yes; Councilman Kemp, yes.
           
(2) Upon motion made by Supervisor Weber and seconded by Councilman Kemp, the following resolution was made that it was:
RESOLVED, that the Map Plan and Report, dated June 2009, concerning the establishment of the proposed Ambulance District No. 1 of the Town of Pulteney, prepared by Hunt Engineers, presented to this Board on September 9, 2009, in all respects complies with the requirements of Town Law Section 209-c;
RESOLVED, that the aforesaid Map, Plan and Report is in all respects accepted;
RESOLVED, that the aforesaid Map, Plan and Report, shall be filed in the office of the Clerk of the Town of Pulteney, New York.
This Resolution was duly adopted by majority vote of the Town Board as follows: Supervisor Weber, yes; Councilman Stone, yes; Councilman French, yes; Councilman Kemp, yes.

(3) Upon motion made by Supervisor Weber and seconded by Councilman Stone, the following resolution was made that it was
RESOLVED, that the Order, a copy of which is annexed hereto and made a part hereof, as if more fully set forth, be in all respects approved;
RESOLVED, that the Order, annexed hereto, shall be published and posted as required by Town Law Section 209-d;
This Resolution was duly adopted by majority vote of the Town Board as follows: Supervisor Weber, yes; Councilman Stone, yes; Councilman French, yes; Councilman Kemp, yes.

In the Matter of the Establishment of Ambulance District No. 1 in The Town of Pulteney, Steuben County, New York :       ORDER
WHEREAS, previously hereto, a Map, Plan and Report was prepared by Hunt Engineers licensed in the State of New York, in such matters and in such detail as heretofore been determined by the Town Board of the Town of Pulteney, New York, relating to the establishment of a proposed ambulance district to be known and designated as Ambulance District No. 1 in the Town of Pulteney, Steuben County, New York.
WHEREAS, such Map, Plan and Report have been duly filed in the office of the Clerk of the Town of Pulteney, New York; and
WHEREAS, the boundaries of the proposed Ambulance District No. 1 are described in Appendix A of the Map, Plan and Report, above referred, and are set forth in Schedule A, attached hereto and made a part hereof; and
WHEREAS, there are no contemplated infrastructure or other improvements contemplated for the proposed Ambulance District; and
WHEREAS, the estimated annual cost to be borne by the one hundred and forty four (144) parcels within the proposed district is Nine Thousand Dollars ($9,000.00). The associated annual operational expense would be raised by a district property tax which is estimated to be approximately $0.48 per one thousand dollars of assessed valuation; and
WHEREAS, the New York State Comptroller’s approval is not required; and
WHEREAS, it is proposed that the expense of the establishment of the district shall be borne by the property owners within the district; and
WHEREAS, the Map, Plan and Report, dated June 2009, prepared by Hunt Engineers licensed in the State of New York, describing the boundaries of the proposed district and the estimated cost, is on file in the office of the Clerk of the Town of Pulteney and is available for public inspection during normal business hours.
NOW, THEREFORE, it is
ORDERED, the Town Board of the Town of Pulteney will hold a public hearing which shall be held within the Town of Pulteney, New York, at the Town Hall located at 9226 County Route 74, on October 14, 2009, at 7:30 p.m. to hear all persons interested in the subject thereof. ORDERED, that the Town Clerk of the Town of Pulteney shall cause a copy of this Order to be published in The Leader and posted as required by Town Law Section 209-d.
This ORDER was duly signed by the Town Board as follows: Supervisor William Weber, yes; Councilman Janet Stone, yes; Councilman Richard French, yes; Councilman Robert Kemp, yes.

            Councilman French made motion seconded by Councilman Kemp to receive and place on file Code Enforcement Officer’s (CEO)/Watershed Officer’s/Zoning Officer’s, Town Justices, Historian, Water Plant Operator and Dog Control Officers reports.  All in favor.  Carried.

Water plant operator Ken Forenz commented that we now have 244 people hooked up to the water.  We are still waiting for the insulation project of the tanks to be done.

NYMIR inspector was here today to inspect the town hall, highway barn and water department.  One thing he recommended was that the wood chips in the playground area needs to be turned over twice a year.  As there is still time to do it once this year the Town needs to consider buying a roto-tiller or renting one to do it.

Supervisor Weber made motion seconded by Councilman Stone to rent a roto-tiller and have the handyman turn the chips over in the playground area.  Roll call vote: Councilman Stone, yes; Councilman French, yes; Councilman Kemp, yes; Supervisor Weber, yes.  Carried.
Highway Superintendents report was given. They finished chipping brush at compost area, patched holes, did shoulders on Gallagher Rd. & Brown Rd., put up signs, put culvert pipe in Thomas Cemetery on Stone Rd., fixed culvert pipe on Judson Rd. and the men have been helping Urbana and Prattsburgh.

Councilman Stone received a clearer quote sheet from Mark W. Cartwright in putting in the drinking fountain.  She explained the problem was his computer program he used to give the quote with.  The cost would be $1,498.99 or less.

Councilman Stone made motion seconded by Supervisor Weber to accept Mark W. Cartwright’s – M&J Building Contractors, Inc.’s quote to install the water fountain for the sum of $1,498.99 or less.  Roll call vote: Councilman Stone, yes; Councilman French, yes; Councilman Kemp, yes; Supervisor Weber, yes.  Carried.

Councilman Stone explained the quote for five (5) items to be done to fix the fence by the basketball court totaling $3,730.00 given by DeWalt & Sons. (1) Remove 6’ fence between basketball court and playground area (some of this can be reused), remove 6 posts, remove gate, install 6 new posts, 30’ new fence, stretch everything in and install new heavy duty tie wires every 2’ for $1,485.00. (2) Install 1 5/8” steel rail on bottom of fence the rest of the way around basketball court being 184’ a together, stretch best can be and retie for $875.00. (3) Tie off all areas around tennis court every 2’ with heavier ties for $385.00.  (4) Install mid rail about 5’ up on fence between basketball court and tennis court as this fence is higher, straighten up fence and tie off for $485.00. (5) Bring in load of asphalt/macadam and fill in between where fence is and basketball court for $500.00.
Councilman Stone made motion seconded by Supervisor Weber to have DeWalt & Sons make the repairs to the fence by the basketball court doing only the first three items on their quote at a cost of $2,745.00.  Roll call vote: Councilman Stone, yes; Councilman French, yes; Councilman Kemp, yes; Supervisor Weber, yes.  Carried.

Supervisor Weber read the following proposed proclamation:
CONSTITUTION WEEK--September 17-23, 2009

Proclamation presented by the GU-YA-NO-GA Chapter NSDAR

WHEREAS,     Our Founding Fathers, in order to secure the blessings of liberty for themselves and their posterity, did ordain and establish a Constitution for the United States of America; and
WHEREAS,     It is of the greatest importance that all citizens fully understand the provisions and principles contained in the Constitution in order to effectively support, preserve and defend it against all enemies; and
WHEREAS, The two hundred twenty second anniversary of the signing of the Constitution provides an historic opportunity for all Americans to remember the achievements of the Framers of the Constitution and the rights, privileges, and responsibilities they afforded us in this unique document, and
WHEREAS, The independence guaranteed to American citizens, whether by birth or naturalization, should be celebrated by appropriate ceremonies and activities during Constitution Week, September 17 through 23, as designated by Proclamation of the President of the United States of America in accordance with Public Law 915, now
THEREFORE, I, William Weber, by virtue of the authority vested in me as Supervisor of the Town of Pulteney, State of New York, do hereby proclaim the week of September 17 through 23 as CONSTITUTION WEEK In the Town of Pulteney, and urge all our citizens to reflect during that week on the many benefits of our Federal Constitution and the privileges and responsibilities of American citizenship.

Councilman Stone made motion seconded by Councilman French to adopt the above proposed proclamation.  All in favor.  Carried.
Supervisor Weber read the resignation from Phyllis K. Peek from the Board of Assessment Review for health reasons.
Supervisor Weber made motion seconded by Councilman Stone to accept Phyllis K. Peek’s resignation from the Board of Assessment Review with appreciation for all her work.  All in favor. Carried.
No public comments or concerns.
Councilman French made motion seconded by Councilman Kemp to adjourn.  All in favor.  Carried.
            Meeting adjourned at 8:12 PM.
