Setember 14, 2011       

The regular meeting of the Pulteney Town Board was called to order by Supervisor William Weber at 7:00 PM on Wednesday, September 14, 2011, at the Pulteney Town Hall with Pledge of Allegiance. 
            Present were: Supervisor William Weber; Councilman Robert Kemp; Councilmen Richard French; Councilman Elizabeth Ryder, Councilman Junior Gibson; Town Attorney John F. Leyden; Bookkeeper Joyce Apenowich and Town Clerk Donna Conley.  Absent was Highway Supt. George McIntyre.  Also present were CEO, Watershed, Zoning Officer Lauren Welch and Historian Sharon Daggett.
Councilman Gibson made motion seconded by Councilman French to accept the minutes of the August 10, 2011 regular meeting.   All in favor.  Carried.
            Supervisor Weber discussed the finance statements for general, highway and water.
            Councilman Kemp made motion seconded by Councilman Ryder to make the following transfers in the General Account:

            Councilman Ryder made motion seconded by Councilman Gibson to pay the General Bills in the amount of $3,000.00 being voucher No. 185 on Abstract No. 9A, the amount of $1,205.50 being vouchers No. 186 to No. 188 on Abstract No. 9B and the amount of $11,735.43 being vouchers No. 189 to No. 211 on Abstract No. 9.  Roll call vote:  Councilman Ryder, yes; Councilman Gibson, yes; Councilman Kemp, yes; Councilman French, yes; Supervisor Weber, yes.  Carried.
Councilman French made motion seconded by Councilman Kemp to pay Highway Bills in the amount of $39.32 being vouchers No. 146 to No. 148 on Abstract No. 9A and the amount of $5,970.40 being vouchers No. 149 to No. 158 on Abstract No. 9.  Roll call vote:  Councilman Ryder, yes; Councilman Gibson, yes; Councilman Kemp, yes; Councilman French, yes; Supervisor Weber, yes.  Carried.
Supervisor Weber explained that there is not enough money in the Water District account to pay Lyon’s Bank’s payment so we need to borrow $12,000.00 from the General account to be paid back when we get the budgetary payback fees in February.
Supervisor Weber made motion seconded by Councilman Kemp to make the following resolution:
RESOLVED, that the Town Supervisor is authorized to transfer from the General Fund to the Water District # 1 Fund the sum of $12,000.00.
RESOLVED, that with this transfer the Water District # 1 Fund is indebted to the General Fund the sum of $43,000.00, which shall be paid on or before February 15, 2012.

Roll call vote:  Councilman Ryder, yes; Councilman Gibson, yes; Councilman Kemp, yes; Councilman French, yes; Supervisor Weber, yes.  Carried.
Councilman Ryder made motion seconded by Councilman Gibson to pay Water District No. 1 Operating Bills in the amount of $800.00 being voucher No. 66A on Abstract No. 9A and the amount of $23,867.80 being vouchers No. 67 to No. 74 on Abstract No. 9.   Roll call vote: Councilman Ryder, yes; Councilman Gibson, yes; Councilman Kemp, yes; Councilman French, yes; Supervisor Weber, yes.  Carried.
Councilman Gibson made motion seconded by Councilman French to receive and place on file Code Enforcement Officer (CEO), Watershed Officer and Zoning Officer, Water Plant Operator, Historian, Town Justice, Highway Superintendent and DCO reports.  All in favor.  Carried.
Training for the Assessor David Oliver at a cost of $95.00 and Code Enforcement Officer Lauren Welch at a cost of $53.00 was discussed.
Supervisor Weber made motion seconded by Councilman Kemp authorizing the Assessor David Oliver at a cost of $95.00 and the Code Enforcement Officer Lauren Welch at a cost of $53.00 to attend training.  Roll call vote: Councilman Ryder, yes; Councilman Gibson, yes; Councilman Kemp, yes; Councilman French, yes; Supervisor Weber, yes.  Carried.
The status of the $3,946.00 bill from Steuben County Dept. of Public Works for the tire disposal was discussed.  Supervisor Weber after investigating other towns found that we were the only town that went over 2-3 T as we had about 23 T.   Board agreed the letter did not explain any limit on the amount we could take to the landfill so they did not feel that we owed it.   It was discussed whether to pay the bill or not.   Atty. Leyden noted that if we don’t pay the bill the County would deduct it from our sales tax monies anyway.
Councilman Kemp made motion seconded by Councilman Gibson to pay the $3,946.00 bill for tire disposal to the County Public Works Dept.  Roll call vote:  Councilman Ryder, no; Councilman Gibson, yes; Councilman Kemp, yes; Councilman French, no; Supervisor Weber, yes.  Carried.
It was noted that the bench for Helen Coombs has been placed in the cemetery.  Supervisor Weber noted he would like to have a dedication ceremony some Sunday afternoon.  Board agreed to have Supervisor Weber contact Pastor Don Peek for a Sunday afternoon in the near future to do the dedication.
The six (6) signs for entering “Pulteney” are ready for final approval from the board.  Jane Russell asked if the board thought of asking the businesses around town if they would purchase a sign and they could then put their name on a plaque under the Pulteney sign.   Jane will put together a list of businesses and give it to Supervisor Weber for him to write letters.
Councilman French made motion seconded by Councilman Kemp to give Brett Steeves the okay for the six signs for entering Pulteney at a cost of $300.00 each.  Roll call vote: Councilman Ryder, yes; Councilman Gibson, yes; Councilman Kemp, yes; Councilman French, yes; Supervisor Weber, yes.  Carried.
The status of NYSEG save energy program was again discussed.  The Town Barn, Town Hall and Ambulance/Town office building were evaluated by EnerPath Services, Inc. for the program.  We need to pay NYS prevailing wages to have the work done.  The Town Hall will cost $664.78, the Ambulance/Town office building will cost $1210.39 and the Town Barn will cost $554.75, which are one-time charges. 
It was discussed and agreed on to just do the Town Hall and the Town Barn at this time.
Councilman Kemp made motion seconded by Councilman Ryder authorizing Supervisor Weber to sign the contracts for the Town Hall for $664.78 and the Town Barn for $554.75 to be done in the NYSEG Save Energy Program.  Roll call vote: Councilman Ryder, yes; Councilman Gibson, yes; Councilman Kemp, yes; Councilman French, yes; Supervisor Weber, yes.  Carried.
Zoning Board of Appeals alternates was discussed.  The only name presented was Denise Smith.
Supervisor Weber made motion seconded by Councilman Ryder to appoint Denise Smith as an alternate for the Zoning Board of Appeals.  All in favor.  Carried.
Supervisor Weber read the following two proposed Proclamations:
CONSTITUTION WEEK--September 17-23, 2011
Proclamation presented by the GU-YA-NO-GA Chapter NSDAR
WHEREAS,    Our Founding Fathers, in order to secure the blessings of liberty for themselves and their posterity, did ordain and establish a Constitution for the United States of America; and
WHEREAS,    It is of the greatest importance that all citizens fully understand the provisions and principles contained in the Constitution in order to effectively support, preserve and defend it against all enemies; and
WHEREAS, The two hundred twenty fourth anniversary of the signing of the Constitution provides an historic opportunity for all Americans to remember the achievements of the Framers of the Constitution and the rights, privileges, and responsibilities they afforded us in this unique document, and
WHEREAS, The independence guaranteed to American citizens, whether by birth or naturalization, should be celebrated by appropriate ceremonies and activities during Constitution Week, September 17 through 23, as designated by Proclamation of the President of the United States of America in accordance with Public Law 915, now
THEREFORE, I, William Weber, by virtue of the authority vested in me as Supervisor of the Town of Pulteney, State of New York, do hereby proclaim the week of September 17 through 23 as   “CONSTITUTION WEEK” in the Town of Pulteney, and urge all our citizens to reflect during that week on the many benefits of our Federal Constitution and the privileges and responsibilities of American citizenship.
In Witness Whereof, I have hereunto set my hand and caused the Seal of the Town of Pulteney, State of New York to be affixed this 14th day of September in the year of our Lord, two thousand and eleven.

Councilman Ryder made motion seconded by Councilman Gibson authorizing Supervisor Weber to sign the Proclamation for Constitution Week.  All in favor.  Carried.
A PROCLAMATION
PREAMBLE
On October 4, 1881 the PULTENEY FREE LIBRARY was established and has operated in the Town of Pulteney for these past 130 years to the benefit of all citizens.
WHEREAS this organization is a valuable and respected asset to the Pulteney community and,
WHEREAS the Town Board of the Town of Pulteney recognizes the importance of the Library to the quality of life in our Town and,
WHEREAS the Town Board of the Town of Pulteney desires to mark the 130 years of service to the community by the PULTENEY FREE LIBRARY THEREFORE,
LET IT BE RESOLVED that the Supervisor of the Town of Pulteney with the consent of the Town Board of the Town of Pulteney hereby declares the month of October, 2011 to be PULTENEY FREE LIBRARY MONTH and that this designation highlights the highest regard and admiration that the Pulteney community has for the PULTENEY FREE LIBRARY.

            Councilman Ryder made motion seconded by Councilman French authorizing Supervisor Weber to sign the Proclamation for Pulteney Free Library Month.  All in favor.  Carried.
            Steuben County Self-Insurance for Workmen’s Compensation payment was discussed whether to be billed in January or have it levied on January taxes.  It is 15.13% higher then last year and the amount is $34,448.00.
Supervisor Weber made motion seconded by Councilman Kemp to have the County send us a voucher in January for our Workmen’s Compensation payment of $34,448.00.   Roll call vote: Councilman Ryder, yes; Councilman Gibson, yes; Councilman Kemp, yes; Councilman French, yes; Supervisor Weber, yes.  Carried.
            Steuben County’s Mobile Work Program was discussed as to whether we want to take advantage of the program or not.  Board agreed if the Highway Superintendent could utilize their help in any way he could call and make arrangements.
            Janet Stone noted that Jerusalem, Milo and Barrington have adopted a moratorium in their Towns regarding hydro-fracking.  She gave the Board members a copy of a law regarding hydro-fracking for them to review.  Public concerns related to what the town is doing about putting something in place to have a moratorium on hydro-fracking were given.  Board agreed a moratorium is of little use right now without knowing what it is for and when it is needed.  Board noted it is in the hands of the Planning Board, which has been working on a road use agreement.
            Dennis Vai, member of the Planning Board was present and explained the Planning Board is working on a road use agreement.  Board asked if they could have a road use agreement ready for the Board to review for their October meeting. 
            Councilman Gibson made motion seconded by Councilman Ryder to recess the regular order of business to go into an executive session to discuss a personnel matter.  All in favor.  Carried.
            Councilman Gibson made motion seconded by Councilman Ryder to close executive session and resume the regular order of business.  All in favor.  Carried.
            Supervisor Weber reported that a personnel matter was discussed with no action taken.
Councilman French made motion to adjourn seconded by Councilman Gibson.  All in favor.  Carried.
            Meeting adjourned at 9:15 PM.
